Sugesstion :I140 still pending and want to use EAD

Hi All,

Two months back I got a RFE for I140 ,and my attorney answered it 2 weeks back and the case is still pending in Vermont service center. Do you suggest me ,if my wife can use EAD to look work ? Currently , she is on H4 and she is getting few job opportunities the only concern is, they need a Social security number.

1.if she applies for a social security number and starts working with EAD and if my I140 is refused , what will be her status ?

2. Can she go back to H4 status , if my i140 is refused ? which documents should I need to fill ?

As long as you are maintaining H1 status...

you guys will have a backup and this is not an issue. In the worst case scenario, spouse will have to go out of the country and come back on H4.
