Hi Everyone,
I wanted to share my story that might be helpful to some of the people who come here looking for answers. This website has been very helpful.
The story in short:
My labor for GC was filed in Dec. 2004 and my H1 was expiring in April 2005. In order to get 7th year extension I needed at least 8 more months. Four of those months were coming from my vacation time. My company had a project outside the US. So they sent me there for another 4 months (Very few companies do that!). Thus I was ready to file a recapture for those 8 months to get the 7th year extension.
I landed in the US just 5 days before my H1 was expiring. The immigration officer asked a few questions and gave me a I-94 with two weeks validity. In the next 2 days, my company's lawyers filed the H1B extension application using premium processing. All the paperwork was ready when I came here. Within a day, the entire period was recaptured till Dec. 2005 (the labor will be filed exactly for one year then).
How did I get entry, how was the time recaptured etc. is all a mystery to me.But I enjoyed every bit of it.I guess the trick is to be prepared for everything in such situations and the outcome will surely be positive.
Good Luck ! I was impressed by my company's lawyers' handling of such a delicate case.
