substiute labor - waiting for 140/EAD/AP

Hello,
I had a substiute labor. My 140/485/EAD/AP was concurrently filed on 5/29/03 (ND 6/13/03) in EB3 category. My H1 will reach 6 year limit and expire in Feb'03 .

1. My lawyers say that because I had labor substitute, I wont get EAD/AP until 140 is approved. Is that true ?

2. What are my options if I dont get EAD/AP before Feb'03 ? Do I have to do file for H1 extension ?

3. Can I get Interim EAD/AP from local INS office ? Is that only for renewl EAD/AP ?

4. I was told that somebody from my company got 140 approval for concurrently filed 140 in Jun'03 in EB3 category with labor resubstitute . His EAD/AP is still pending . Does that sound true ?

5. What are chances of getting 140/EAD/AP before Feb'03 ?

-------Great Lawyer. Mine is also a Labor Substitution case and I got my AP and EAD within two months from NSC.

2. What are my options if I dont get EAD/AP before Feb'03 ? Do I have to do file for H1 extension ?
-------i) Go to Local Office and get interim EAD
ii) Or File for H1B extension.

------- You did not mention about the service center, where you filed. If it is Nebraska Service Center, then it is true. People who filed in July 2003 also got their I-140 Approved.

5. What are chances of getting 140/EAD/AP before Feb'03 ?
---------Again, You did not mention about the service center, where you filed. If it is Nebraska Service Center, then there is a strong possibility that you WILL get your I140, EAD and/Or AP approved by that time.

Mine is Vermont Service centre. Whats yours ? probably my lawyers are giving some excuse for me not getting EAD/AP...
