Substitution Labor and I-140

I am software engineer and my company is offering me a substitution labor
on which already I-140 has been applied and even got cleared .
But I-485 was not applied.
The substitution labor is fully matching my experience, salary etc etc.

My question is
1. Is it possible to substitute someone for a cleared I140 for which I485 was not applied? :confused:
2. Even if substituted, then is that the substituted person can be successful
in the process of clearing I140 for him ?

My humble request is avoid such complicated cases. If you look at other threads related to cybersoft you will understand why I am saying so

Substitution of Labor by itself is a risk..In your case it is more of a 140 substituion. That person might have filed 485 who knows !! And if they process his application first then yours will get rejected.
Secondly how are they going to file your 140 without the approved labor ?? Has the company revoked the 140 filed for that applicant ??

Do you have any idea how long it will take to get your I-140 approval from VSC?

Go for it !!!

Dude go for it, looking teh retorgession currently it may be while to start PERM and then I-140 all fresh together.

What you should look out is it desi-consultancy or Amru or kinda of ppl you are dealing/working with it . Morevover hope you are not paying anything out-of-pocket for this.

If you are sure that I-485 was never applied you can use it. Many compaies have such cases because of some one applying two labors or spouse applied for GC.

I wish i knew this..But I am hoping it happens before the end of the year. Even an astrologer cant predict how the INS will operate..especially with the holiday season starting soon you never know !!
