Substituting labor (Is it safe)

Hi Guys,

I am on H1 b Visa , I have recently changed my employer,
New employer has a preApproved labor with him and he has aggreed to use that labor for me.

How safe is it to use others preapproved labor.
Is it legal??

One more issue is that the labor was approved for a person who had a Masters degree, but mine is bachlors with 8 years of experience.

Can I use that labor and file I -140 and i-485 concurrently.

What kind of queries may come if any??

Subtituting labor is not a problem.I got aproval last month with subtitude labor. But if the qualification are different you may get REF. Better check with a good lawyer.
 
It is not a problem using a substituted labor, as long as the mininum qualifications and required skills in the ETA-750 match with yours. Make sure the company has solid background with process of previous labor applications and some greencards.
