I wonder if anyone knows the correct answer to this question?I married a us citizen in 1999 had a child and filed all necessary paperwork for a permanent residence received a temporary work permit,social security number etc..My wife died 4 months before our immigration interview.A the interview the ins officer told me that the application cannot be approved(we were not married yet two years)I never received a notice from the ins about this.Recently someone brought to my attention the fact that in these cases you can use a substitute sponsor.I have two brother in laws who could do this.I contactec an immigration lawyer who old me that spouses were not eligible for this .
I cant find any mention about the spouse not qualifying on ins website.
