Lets say, LC was approved for employee A, I-140 was filed on this LC and was approved. Employee A left the company before filing I-485.

Can this LC be used for filing I-140 for another employee (similar qualifications, similar job...)

Same as yours.. My company applied on Feb 22nd 2002.. I am waiting to hear from INS...

When I inquired my lawyer, she said , INS is submitting these cases to a special review committe .. may take couple of months to hear from INS..

Hello gurus over there, If have any experiances sililar to this please post on these and all can be aware of what is going on....

Can you please clarify for below:
why it is diificult by using substitute LC for filing I-140??
Is these cases treated different from normal??
If pre-approved LC has I-140 approved, using that pre-approved LC for other person is difficult?
If there is no prior I-140 approval for that LC,using that pre-approved LC for other person is difficult?

I am using pre-approved LC to file I-140 but its not having prior I-140 approval thatswhy I am worrying about my case. Can you please reply.

Thanks a lot for the info.. Why is the special memo.. I mean earlier there is no need for employer to provide a copy to INS???

That means, All who have applied in this category need to send a copy of LC and related info now to INS... Is my understanding correct???
 
If you don\'t have the original LC - Problems

INS needs to get the original from the old file. For some reason, INS seems to have problems doing that. It seems simple to me (pull the old file and get the original) but INS doesn\'t seem to be able to do this without causing problems.

Jim, Substituted LC and filed for I-140

Jim,
My company filed for my I-140 on 25 March 2002, substituting a pre-approved LC. But in a couple of my friends\' cases, the substiution procedure seems to take longer(although not as long as direct LC application). Can anyone tell me how long this could take in my case. Your views will be highly appreciated.
