I have a question regarding extension of my H1 which completes 6 years in May 02. I began my green card processing only in Sept 01. My company used an exisitng approved Labor from a terminated employee, and has now filed my I-140 just recently. The priority date assigned to me is 1/12/2000.
If my I-140 does not come thru, and my I-485 is not filed, do I get an extension of my H1, looking at the priority date? Or do I not get it since I have not had 1 year of processing time?
What is the criteria for getting an extension? Do I need to be in process for more than 1 year, or is it dependent on the priority date only?
