Hello, All.
I have applied thru substitute labor.

They got the certificate for MASTERS degree.
I have only bachelos degree.

My lawyer says since i have over 5 yrs of experience.
it is fine i can apply for my gc.
Is it true?

Guide me in this regards..

You can successfully use the substitute LC provided:

1) The LC states MS OR BS plus 5 years experience,
2) Your BS degree is certified to be equivalent to a US degree,
3) You meet all other minimum job requirements.

In addition to the details provided by nkm-oct23, you also need to have experience letters which shows your "progressive" experience in organization. Also the experience with your current employer is not counted towards it.

You must have met all the educational and skills qualification before the initial date of filing of the original LC application. So if LC was filed in Aug 1999, you must have had all the education/skills on the LC before Aug 1999 [doesn't matter if you were somewhere else then]. Anything you acquired after Aug 1999 wouldn't count. AS FAR AS I KNOW.

It is not true. You need to have same educational equivalence and work experience as the one stated on LC on the date when LC was filed. There is no way in which educational equivalance can be translated into work experience.
