Substitue Labor Certification

Hello All !

My company does have an approved LC that is unused ,however I was told it cannot be used for my case -since my profile is not a 100% match with the approved LC.

The educational qualification on on the substitute Labor certificate is a Masters in Comp. Science, whereas I have an Bachelors degree in Computer Science.

Is it true that everything has to be a 100% match ( even education)before a substitue Labor certificate can be used ?

Sorry .. but the truth is..

Yes.. your educational qualifications and experience should match those specified in LC at the time LC was filed.

You should have MS in Comp. Sci. by the time LC filed was filed, not even now.

If LC says 2 yrs of experience-- you should have that experience at that time not now.

LC substitution cases are tough because-- Normally the job requirements are moulded/twisted so that Company receives minimal responses that match the criteria. And now to use LC for some body else he should have that unique qualifications.
