Subject to Quota?

Hi Gurus,

I have valid H1B stamp on my passport (valid until Feb 2007). I-797 expired in Nov 2005. Planning to arrive in USA after getting I-797 from new employer. H1B will be filed in this week. Am I subject to quota?

Received different opinions about this issue. Your input will be greatly appreciated.
 
Were you in US for the past 6 years? if not then you won't be in the Quota. When you first get h1 approved you could stay in US for 6 years and you could jump to another company by just transfering the visa.
So now if you are out of US for less than a year you could use the same visa and as a transfer to another company....

Only thing you have to check is,since your are out of status is it possible to use the same visa ?? what does u'r employer says? h1 b transfer or new h1b
