My wife is currently on H4 visa, which expires on May 30, 2007. We have filed for her H4 extension, I-539 application for extension of non-immigration status, along with my H1 I-129. We have also received the receipt notice for this petition.
She is joining New York Univ DDS program this summer and her college starts on June 4th. Is she eligible to study based on the notice/receipt of petition for extension, even though her visa expires on May 30, 2007 ?
Office of international students at NYU is okay with this situation, but some of the autorities in the admission committee do not understand this situation and are going to cancel her admission.
I know H1b holders when filed for extension can continue to work for the same employer even if their visa expires. Is this eligibility documented somewhere on USCIS website, that someone can point me to?
To expedite this matter, my company has also filed for premium processing on May 17, 2007. This also puts her H4 I-539 on premium processing, right?
