Student want to apply for GC

HI all ,

I am a student , currently pursuing my Master of Science program in Computer Science in Louisiana. I have been in the US since Fall 2000. (This is my second Masters)

I have a paternal uncle and a paternal aunt in the US who stay in New jersey. They are US Citizens. Both are my fathers direct siblings.

I was wondering if it is possible for me to apply for a Green Card.

If yes, how can I apply for one ? I am entitled to apply as a family applicant ? (My father has not been sponsored by my relatives stated herewith as of yet).

I would really appreciate any help in this regard. Thanking in advance.

Regards,

Hi,
You are not regarded as a direct relative of a US citizen. So I dont think your distant uncle can sponsor your GC.The first preference is spouse, parent or unmarried child below 18 years. Then brothers and other direct relatives.

Thanks a lot for your reply.

I am aware of the fact that I am aware of the fact that my uncle (who in this case is NOT a distant relative) but is not my direct blood relation cannot sponsor for green card.

I had supplied the information as a background.

I wanted to know if I can apply for GC directly while am as a student or do I have to have an employer to sponsor me.

Hope to get some concequential replies.

Regards.

Hi,
I am also a student and I am applying for GC as my wife is a USC. So in your case you probably have to apply through employment. I dont think INS allows someone to apply for GC sponsored by an uncle. Please cross check with the website and get the list of relations a citizen can sponsor for GC.Hope this helps.

You will need an employer to sponsor you, since you do not have a US citizen/LPR parent/brother/sister/spouse.
