My husband's name check has been pending at FBI ever since Dec. 2003. So, that makes it 42 months... 42!!! months, or 3 and a half years!!!

Anyone who waits longer than us? Or you've seen/heard anyone waiting longer than us? Please post your waiting time here.....

tuktukan, your friend rocks! I suppose you don't know in which month of 2002 he/she submitted I485? NP, I'll just assume it is June 2002...

So now the new record: June 2002, or 5 yeas, 5!!! YEARS! Anyone earlier than that?

No, our NC has not been cleared yet... It is still pending at FBI... So we are on the same level, maybe you'll get a silver medal and I'll get a bronze one in the competition! :) Just kidding, wish you good luck.

Have you guys tried all possible avenues: WoM, call/write to COngress person/Senator/First Lady, etc?
 
Sulingli..I don't know exactly what month but he's been complaining about his green card application for 5 years now. I'm not sure if he's doing anything about it, but I will surely tell him about this site.

I'm in interesting position. I don't want aproval of my I-485 now.
If it'll be somewhere in September, it'll be great!
I need to go and stamp H1B in my passport, H4 in my wife's passport and bring her here before the GC approval!

Have your US Senator camped out at the FBI until this is resolved..

I tried our Congresswoman, Anna Eshoo, but she can only confirm on the pending status of my husband's name check with FBI, not expedite request or other.

I will try ombudsman next ... and maybe FL later... haven't got an idea on how to draft the letter ...

I am possible victim of name check.

I filed my 485 in July 2003. Still counting. 4 eads and going to file 5th ead in 3 months.

once dates are current I wil lcall and ask final time before doing anything else. I will wait for another week and then proceed. I already contacted senator and got no reply from him.

Could this really be happening?

This sounds really strange that some of the name checks go back to 2003. How is this possible? Could you reason even remotely why this is happening? It seems quite arbitrary. Sometimes getting a congressperson's help might expedite things from what I hear. Can you get a reason from the relevant authorities why your name has gotten stuck?

On the other hand, there are relatively few who responded thus far, which makes it seem like getting stuck may not be as common as we think... who knows. We can only speculate and hope for a quick resolution!

I am really surprised to see that so many have you have such a good attitude towards this. That's great! :)

Well soc_aus there is "Nothing" we can do to expediate Name Check clearance. I have been stuck since August 2004 which is no where close to others in this forum but still feel the pinch....

My 10 year old and 8 year old kid's name is still pending in "Name Check"... What do you say? :rolleyes:

Mine is pending since March 2004. The farthest I went to resolve this is writing to FL. I am yet to see if that had any effect. I think Writ of Mandamus is still an option. I spoke with an attorney last week and he said that despite that USCIS memo that says they will not request FBI to expedite NC the Writ still works up to this date. So I suggest everybody look at this option. Wouldn't it be great if we all file writ in one month so those bastards lose their sleep and adjudicate cases 24 hrs a day for eternity. This would be Dante's hell for USCIS and FBI. :mad:

I am sorry to hear about your situation. It must be very frustrating...but I think after a while you get numb to the waiting, accept it, and move on. I got these information which you perhaps already know.

I read that about 1% of the cases gets significantly delayed. There were 3,346,435 name checks in 2005 and about 1% of them would have been expected to be delayed for an extended period. More info. is available at:

One thing though, can you get the info. why your name got stuck? That could at least get you some relief rather than speculating.

all case undergo namecheck. but most of them are cleared in 2 weeks. unfortunate like me gets stuck for 4 years and still waiting.
 
Congressman/Senator question during Infopass #2, conversation with imm. officer

Guys,

I was assured that I am stuck in the name check when I did infopass #1 in local imm. office in April 2007.
On May 31, 2007, I went there again to the local immigration office..
Talked to a real person, he confirmed that background check is still pending. When I said that I am going to write a congressman (which I actually did last week), I've got an interesting reaction. His body language and facial expressions became very alarmed and he started to discourage me from doing that saying that if I write a congressman, the NSC will have to transfer the file to the local office and this will delay the I-485 significantly. I told him that my I-485 is stuck since Feb. 2006 anyway and I will get at least some movement on my case. He kept telling me that I should not do it which actually made me think that I definitely have to keep bothering my congressmen.
Bottom line - DO write to your congressmen/senators if you have nothing to hide. I am sure that lots of people had some (minor or major) problems with immigration that is why they stay silent American bureaucracy is afraid of people and people’s representatives in congress/senate. More voices will be raised, better they will be heard.
In addition, I asked the imm. officer if the fee increase will actually speed up the process and he said that it MIGHT but he is not sure.
That is all.
