Strange RFE ?

My attorney had submitted my Engg.Degree Certificate as well as my Evaluation Certificate still I got an RFE saying - "Alien\'s case can\'t be processed in EB-2 due to absence of Bachelor\'s Degree".
Can anybody suggest as to what direction should one take -
a)Send the Degree Certificate and Evaluation Copy again as documentary proof(Is it worthwhile questioning examiner\'s authority?) Or
b)Send a reply agreeing for EB-3 category(Priority dates are current for both as of now)

Any help will be highly appreciated.....

depends on what your lawyer or your employer wants to do...

It is also possible that the lawyer simply forgot to include the ed. evaluation with the application package...in which case, the lawyer might just send it "again".
