Strange RFE... Please help My attorney just called to say that I have received an RFE.
Case Details:
485 RD April 2002. WAC02169XXXXX
Second FP scheduled on June 04th 2004
I used substitute Labor with company A. I140 approved. I 485 filed and pending. I have so far not worked with company A at all.
RFE Details:
Details about two approved I140s..
Two years W2
Three months pay stub
Verification letter
Employment letter ( are they different from Verification letter?)
Questions:
1. Is it usual to get RFE on why two approved I 140s? Is there any cause for concern?
The only reason that I can think of is that I started GC through my ex employer Company B. Filed I 140 and the company went bankrupt and laid off all employees. So I started a new GC with company A all together.
2. I have never been on the payrolls of company A so far. I am with Company C ( on a similar job and similar pay)
Can I Use AC21 ?
Is it safe to get on payrolls of Company A now and show three paystubs..?
