Strange RFE on I-140

Hi,
We received the following two RFEs on my I-140.

1) In plain English detailed description indicating why five (5) years of post baccalaureate and progressive experience would be necessary to successfully perform the duties set forth in a highly technical job description.

2) Describe the position being offered so that it can reasonably be determined whether the job actually requires an advanced degree or five years of post baccalaureate experience that is progressively in nature.

My attorney tells me that this is a strange RFE and she has not seen such a RFE in the past. Has any one received this kind of RFE ? If so, could you provide me an insight as to how we could frame a proper response so that we can get the I-140 approved without further queries or denial. Please advise.

Let me tell you one thing. I have heard this statement for many lawyers. These can be categorized into two types:

Evil Lawyers: These lawyers are so evil that don't submit proper evidence at the begining of the case and want to get an RFE so that they can charge more to the client. My lawyer, for eg. did not even submit employer's tax returns while filing for 140.

Dumb Lawyers: These lawyers are basically technically incompetent. They don't know squat about law but sit there and make money. They show as if something is too complex while the fact is that they don't know what to do.

This is the job of your lawyer. You are paying him/her 1000s of dollars to respond to this. While there many knowledgeble people here who will definitely provide you some clue about this RFE, I request you that once you are done with this lawyer, expose him at http://www.lawlesslawyers.com

I guess your attorney filed EB2 with EB3 LC because you have an advanced degree.
You have to switch to EB3 if USCIS suggested in the RFE.

Could you pl. share what you did on your I140 RFE finally? Did it get approved. I'm in exact same situation as yours, same wordings on the RFE ...
