strange, my AP got approved

A couple of months ago, I got AP from Dallas district office due to an emergency. The officer while issuing the AP told that my application pending (ND 8/2/2003) will be automatically cancelled.

Well guess what! My application is approved on 2/18. My wife got a RFE for I140 to submit RFE notice.

AP expiring and wife not in condition to travel

Help Guys!!!

We were in India for my brother's marriage and while we were there thought why not try an IVF there as we had unsuccessful attempts here.

Guess what, it worked and now she is expecting. However, since this good news is coming to us after 8 long years we can not afford any chances and so she won't be able to fly back before 03/27 when her current AP expires. Unfortunately, I wasn't checking this forum or following the status too closely to realise that AP in TSC is taking around 5-6 months if you're lucky and so have filed for it only on 01/15/2004.

Now obviously, I want my wife to be here with me as I want to be as much part of the joy that she is experiencing after such a long time but the more I think about it, the more I feel bad after looking at cases where people have waited long time and I don't want the flying back to be close to the due date also.

What are my options:
1) File an expedite with TSC?
2) Goto local INS (I don't think there is such thing as interim AP but redhat got it approved from local office). Also, my situation is different as my wife is already in India so she won't be able to go in person to the local USCIS office.
3) Appear at the local consulate for visa on humanitarian basis or with letters from senator or congressman?
4) Or any other idea ??

WhyTSC - First of all, congratulations to you and to your wife. I can imagine the feeling.

If I understand you correctly, you don't want your wife to travel in the first few months, but not wait too many more months either, for your current application to be approved. I think that this is certainly a very "special" case that you need to write to the TSC director about. You can explain that when your wife went to India, she had a valid AP and every intention of returning before it expired. Because of the circumstances, you can explain that she wants to delay her trip back. You can give TSC a tentative date for her return and request her AP approval before that date. Get documentation to support your petition before you send it in (Doctor's letter etc.).

One note of caution though: I have seen in several postings in this forum that a pending AP application has to be approved before the person leaves the US for them to be able to use it. In this case, you have to request TSC to make an exception. I think that your congressman or senator will be sympathetic - I would recommend that you use their help. Be sure to consult your attorney also.

First of all Congratulations for you!! We are also planning to do the same after 2 failed IUIs
picsarus is correct. The only way you can expediate the AP is to write TSC and find some sympathetic officer. Meanwhile, seek the help of a local Senator also...

How did you approach the local USCIS for AP? Is there a process for this or TSC referred you to them?

Please reply ASAP.
