Strange 485 Denial, Big upset !

Dear All:

May be I am the most unlucky person here. Me and my husband filed 485/140 and EAD in July 2004. We both got it in 10 days. I am an RN - Schedule A Nuse. We got an RFE on 140 and 485 on November 2005.
140 - Paystuff and hospital's tax return.
485 - Our Medical and an emplyement letter from hospital.

We submited this within 2 weeks.

Decm 21, 2005 - I 140 approved.
We were waiting for Finger Print or Visa Screen RFE. Nothing received till may 30, 2006.

On May 30th, since our EAD is expiring on July 30th, we filed extension on EAD along with Advance Parole (We did not visit native place last 5 years)
We submited Visa Screen and our 2005 tax return too.

No response till July 20th, 2006.

On july 21st, we received 2 letters denying my husband's AP and EAD, saying they cant issue this because our I 485 is denied. It was a lightning shock for us. We dont know what is happening. Next day we went to attorney, next big surprise was there. There was a letter there denying my I 485, saying I did not appear for the finger print.

The most interesting thing was That letter was dated March 8th 2006, and they posted on july 18th along with our EAD renewal application. And this letter says, you have to file MTR before April 10, 2006. And CC to an old address , that was changed in 2005 (In fact we received last year renewed EAD on new current address), so they cant send this letter to previous address.

I doubt, they fabricated this letter. Why they are doing this ? Did anyone had this strange experiance ? If they want to deny, they can deny in proper way right ?

Neither we or Attorney received any finger print notice. No update on case status, since November, 2005 (Medical) - on Email.

We dont think we can get it through, since they created a mess and they have all stories to support it.

We filed a MTR, saying we did nt receive any fingerprint notice and produce an affidavit also.

Can I sue this guys ? Can I write to President Bush or any higher authority on this ? Will it help ?

Can anyone advice me what to do next ?

Since you filed MTR, take it easy now. There are 100's of cases similar to this, FP not received. They will send you FP after formal opening of the 485 case with MTR.

Here is the current status of my case (See orginal posting- 485 denied on FP issue)

MOTIC Motion was re opened on Sept 05th 2006 (Filed on Aug 08th). They send FP notice same day.

We filed EAD on Sept 6th and received receipt dated Sept 11th. But Not approved yet. Can see only one LUD on that case on 9/20/2006

FP done on 9/19/2006
LUD on 485 - 9/19/2006, 9/20/2006, 9/27/2006,9/28/2006, 10/18/2006

I dont know why they are approving atleast our EAD so that we can work legally.

Any thoughts on my case ?

Dear friends.

My GC approved today. It was a short journey with many upsets. Filed in 2004 August Registered Nurse.
case was denied on FP issue and reopened on Sept 5th 2006.
After that, these are the LUDs
LUD on 485 - 9/19/2006, 9/20/2006, 9/27/2006,9/28/2006, 10/18/2006, 11/03, 11/04, 11/16,11/17, 11/20,11/21 and Finally 11/27 - Approved

Both Husband and Me.
