Still confused...

1. My husband I-94 which was given at the port of entry is expired on Feb 2003.
2. H1 Visa with this company got expired in April 2002.
3. Last year he applied for a new H1B and got approved, attached I-94 is valid till 2005.And we did not revalidate.
4. He quit the company and joined other company with EAD.
5. His H1B company cancelled his H1B after informing us.

Now if we travel outside of the country
1. Should we give I-94 of cancelled H1B or show 485/AP documents??
2. At port of entry when we come back, would they give us a new I-94 after whatever they supposed to do with AP?..

Pls let me know the procedure they do at Port of entry when using AP??..

Give the I-94 that was given when you came into the country. I dont think the expiry of I-94 would matter. I know of people who have used I-94 that had expired 10 months earlier while leaving USA.

At Port of Entry, they should give a new I-94 with the words 'Paroled until' & a date that's greater than AP expiry date.
 
I forgot to include that you dont have to show 485 or AP documents while leaving USA.

When you come in using AP, they make a photo copy of it and stamp the AP and I-94 with 'paroled until' & date.
 
While entering US, at POE they will give paroled until (one year from the Date of entry) to resume adjustment of Status. And put the same stamp on your AP also.
 
While leaving USA give all the I-94s that you have. In between first H1B and EAD there was another H1B and the expired I94 is needed to show the continuity.
In fact as a general rule all the I-94s expired/unexpired/new/old should be given at the time of leaving the country.
