Steps to fire lawyer

What is the best way to get rid of the incompetent lawyer that is acting more like speed breaker (sits on paperwork for ever) and actually appears to be misleading - not consistent with common sense - like applying in TSC rather than CSC
 
Most lawyers are like that ( at least my lawyer is). I wish I could fire my lawyer too. Every time when I ask her questions, her answers are always "Don't know!", "Not sure!", "Can't help!". Sometimes I wonder why I need this lawyer. They only care your payment but your pain.

It is too late to fire your lawyer at this stage of the game. You may have to live with it until you get your approval. For one thing it is hard to blame her/him for filing with TSC not CSC. Before early 2001, TSC was the fastest in I-485 approvals (about 14 months). Though in retrospect, she/he had obviously done the wrong thing.

Lawyers are just like other professions, some are good and some are really bad. My first company lawyer messed up my Labor back in 1998 and I missed the fast track to GC later in 1999-2000 (do you guys remember it took 2 weeks to get I-140 approved and about one year for I-485 approval at that time?). After I changed my job, the new company lawyer is good. Knowledgeable and speedy in filing. I feel that I was lucky.

First .... find a competent lawyer.
Second .... File G28.
Third .... send a letter [ certified mail with return receipt ] to old lawyer that you intend to appoint new lawyer to take care of your case from now on .... and ask to send your entire immigration file to the new lawyer to the address [ new lawyer's address ] provided.

By doing this, she/he HAS to handover your docs to the new lawyer.

If the new one is indeed competent ... you'll get expert guidence during this whole procedure ... or else .... look for a new one .... and the search goes on ....

You are probably right. I think I am late already. My status changed to RFE sent on Friday and probably RFE is on the way. My main concern is my lawyer sitting on RFE and not telling me about it and taking too long to reply to it.

She is PAIN - real PAIN.

I know about RFE because it is on web site. She probably would not tell me - very unethical and useless.

Is there something I can do to handle her ?

If the lawyers office is nearby. Tell her politely that you will visit the office, get the papers from her and mail it yourself. ;)
 
Toolongawait - I am going through the same thing. I constantly check my online message and update my lawyer about the happenings. I have no idea if she has sent the reply to my RFE yet.

One suggestion is to mail her once in 2 days till you get a reply. Good luck.
 
Lawyer dead

A customer calls an Attorney office and asks for the Attorney he has been dealing with for the last few years.

Customer Service Rep: "Sorry, sir our attorney died. "
Client: "Oh really. I am sorry to hear that."

the next week,
Client calls again and the gets the same response. This goes on for 4 to 5 times.


The Customer service lady get fed up this time

Customer Service Rep: "Sir, How many times I have to tell you that the attorney is dead. He no longer available"
Client: "I am just calling to hear you say that my attorney is dead. :-)"

Nice joke.

On one hand we had (have) lawyers like M.K. Gandhi and Rajiv Khanna (he is fighting for worthy cause - may not be same level as Gandhi but very few people in the USA fight for principles and community), on other hand we have incompetent, slow, useless, pathetic bunch too. We need to make a list of most useless immigration lawyers.
