I have been married for one year now and have a problem getting my step children back to the US. The children were here in the US when we met. We let the children go back to their home country while their mother's immigration status was changed (big mistake looking back) Now they have been approved to return, but its been a year's wait already since the approval. They are under their mother's permanent resident status only. Thier mother and I were married right after she gained her permanent resident status, so now technically the kids are my step children, however we never notified immigration of this since we had the approval for the children to come back so fast under their mother's status only. Well its seems they are on a long waiting list we are learning now.
Question is, what is the best thing to do here? Should I file new I-130 forms for them since I am a citizen or can an adjustment be made to their current paperwork thats already approved and waiting on the Embassy? They might get the call now any month for all we know and I am worried that if I file to change their status to under me it means starting this whole waiting process once again.
