The I-94 for all four of us ( myself, wife, Daughter and son ) is expiring by 08/31/03. Now that I-140, 485 and EAD is still in process, my EAD and my wife's EAD, will definitely not come before this date from TX center.
My I-140 was filed on a pre-approved LC on June 2002. On May 12, 2003, INS requested for RFE to confirm that the LC has not been used for any previous processing. My lawyer sent that same and has been accepted on June 6, 2003.
Is it legal to be in US after this date with pending I-140,485 and EAD ? I am on a project with the same company and this may continue for a year. Can I continue on my project after Aug 31st, 2003?
How about my kids ? They do not have anything like EAD pending?
I have 1.5 more year of H1 out of six year limit. Shouldn't I file H1 extension right now, if answer for question 1 is NO?
If answer for question 1 is yes, what if anything get rejected?
