Hello all,
I am confused after reading all the related posts for stays between 180 days plus and < 365 days.

Do I need to apply for a re-entry permit for such duration?

How detrimental could such trip be in sustaining my GC status?

Folks any of you have already accomplished such trips your experience would be very much appreciated.

Is it a good idea hiring a lawyer for applying a re-enrty permit? Did anybody apply on their own? Which would be the form that you will need to fill?

How much is the need for STRONG supporting documents regarding the reason you want such an extended absence from US. For me I did not visit my family for the last 5 yrs since I came to US. They did not see my daughter(2.5 yrs old) and they could not travel bcoz my dad had high cholestrol levels and thought the trip would be dangerous. Now I want to go back and spend some time with them for a year or two.

Would this be a justifiable reason???

I am not sure if I can procure all the medical documents for my parents in a short period. What should I do? I wish to travel in another month or two.

oracle, i'm not much familiar with indian corporate laws but is it as easy as it is in the u.s. to incorporate a company. if it is and if it's only matter of a couple of hundred dollars, then i would suggest forming a company in india.

this way you can show that you were trying to establish a business in india where you can import/export goods and services to the u.s. which required you to stay in india, prepare the groundwork, study feasibility, prepare lines of creidt, raise capital etc etc. at the end of the day, you can say it didn't work out but you'd have the paperwork to prove you did form a company. that would be my reason if i was away for more than 6 mos.
 
Establishing a company overseas can be an indication to BCIS that you may have intentions to abandon your permanent residency. Whether that is true or not is another matter.

If you are going to be gone for more than 6 months and less than a year, you are typically not required to have a re-entry permit. However, it certainly doesn't hurt to have one.

i guess i should have been more clear, it takes less than $100 to incorporate a company in the u.s. have a counterpart in india to show that your intent is to do business between the two countries, hence keep the permanent residency status. the other aspect would be to buy a property, but unless you can poay the mortgage every month or get a tenant immediately, that'll be a very expensive method of maintaining perm residency status.
 
So, you think my family related reason is not one of the reasons for which I may be granted re-entry permit?

Are there any whose re-enrty permit request was turned down? What is the effect in that case on naturalisation?

i incorporated a company two months ago that cost me $85 in michigan. the tax i.d. is generated automatically when you call the IRS with registration information which I obtained from the sec state's office. besides, everything and anything can come back and bite you if you aren't careful. I had a lengthy discussion with my employer's inhouse immigration lawyer regarding this topic. Seldom has INS conducted investigation (he didn't know of any and he's been practicing for over 12 years) during naturalization proceedings so they could care less what you have done during the 5 years after getting your GC.

If there is no income, then you can file the taxes yourself. and for the first year, if there is no income, then there is no reason to file taxes for the first year. from the second year, one needs to file taxes 4 times a year which i am assuming can be done from india or the birth country if one is staying there during that time.

anyway, if anyone wants to do that, it's their business. I'm offering an alternative to filing for reentry permit and raising flags about one's residency.
 
if someone is filing for re entry permit then it doesn't matter what reason he provides, re entry permits are like EAD cards, they aren't rejected but just handed out with the proper filings. . I could even say i got homesick and went back or i went to look for that special someone and couldn't find anyone i like and now i want to return and that'll be a good enough reason to issue a reentry permit.

i was thinking the point of this discussion was how to come back after a considerable period of time without having a re entry permit and show a legal and plausible reason why someone was away for so long. If it triggers an audit, that's why you have the paperwork.

I personally want to go away for six mos to explore business opprtunities between two countries. that's why i incorporated a company here, i'll do the same when i go to my birth country and because i have first hand experience in this, i was suggesting people do the same. If i have to file a reentry permit, that's what i'm putting in. if someone has a more compelling reason, then they put that. Although i still beleive the best excuse is to have property here.
 
like i said previously, that's my opinion and my future plans. If it coincides with anyone, great, if not, bravo. you can go ahead and do your due research to prove me wrong but please don't accuse me of being irresponsible. This is just a forum for a variety of ideas. And as much as you'd perhaps want to believe, I don't think anyone is rushing home to implement whatever you, I or anyone else suggest here.

it'll be suicidal to lie to the INS especially in these times. And I've never asked anyone to do that. But there are acceptable levels of risks in everything in life and I have repeatedly stated I'm more of an adventurist and a risk taker than the average person. If anyone wants to try it, they do so on their own. Nobody is a child here.
 
Departure / Re-entry record

I was wondering if someone departs from Canada what is the process of keeping track of this person's departure / re-entry record. In that case how do they keep track of departures and re-entry's from US.
