May case has been pedning since 2004 in name check. Congressman,senetro,FBI,ombudsman the list goes on. Is there any thing else I have failed to follow up?
 
File Writ of Mandamus or wait. There's nothing else to do :( :(

looks like you ran out of options. That's too bad. Will the law suit risk each individual applicants?

Mine is pending since Dec. 2002... :( :mad:

IF I was in a position like you guys, I would have definitely considred filing the writ of mandamus. From what I have read so far, it seems like the chances of getting a positive result is very high if the waiting period on 485 is more than 2 years. In your case it has been over 3.5 years.

I am one of the people stuck in this name check hole since the last 13 months. I will definitely be filing the writ if I do not hear a decision by the next 10 to 11 months.There is no point waiting for things to happen. I am better off getting a denial than waiting forever with the hope of getting a GC. I can atleast plan for my future and make some long term decisions.

Yes, they did. I know at least a couple of people. THe process is not that complicated if you carefully read these forums, but I decided to do this through my attorney

What is the worst that can happen?.They will dismiss the case in which case, you will have to continue waiting again which is no different than what you currently are doing.USCIS cannot deny your case unless they have a reason. Just filing the writ is NOT a reason to deny you your GC.
Also 99% of the cases never get to the trial stage.Usually as soon as you serve them the summons, they get off their fucking asses and start working on your case and before the stipulated 60 day, you will get your decision and the writ will be dismissed. Do you logically think that the director of FBI or CIS will apear in court trial as a defendant.No way man.THeir time is way too valuable.THey would rather work on getting your case through to CIS to adjudicate it before the statutory 60 day period after the summons are sent.

It is also not that complicated at all.It costs only about $150 if you file it yourself.There is no way I am waiting 4 years.As soon as my wait nears 2 years, I am filing it. THis is fucking insane.People who have filed way later than us are getting approved. If this goes on for some more time, it will not be long before the dates retrogress again and then even the lawsuit is not an option.

I comletely agree with you. The whole process is absolutely unfair. People with RD of 09/2005 are getting approved and we are waiting and waiting forever.
 
Adjudicating immigration applications is a very labor intensive process, and one that takes time, sometimes months or years. USCIS district offices do regularly screen their pending caseloads to make sure nothing falls between the cracks. Details of background checks are never shared with applicants or their representatives. This can certainly be frustrating in cases of denial where the applicant has no idea what he or she has "done wrong."

Whats making this worse is that there is no end in sight. The laws and rules keep changing every day and there is no telling when the dates might retrogress again.
Mette have you already filed the WOM suit??.How long have you been waiting in this queue??

I'm also very concerned that the dates might retrogress or that the visas might become Unavailable like it happened last July-October.

does it work by writing to him? I doubte it. But give it try...

I wrote many letters to NYC district director and got nothing.
 
I have contacted the senetor's office regadring the follow up. Senetor's office is of the opinion that
it would do more harm than good, if they contact FBI. No where to go :(

Some one suggested writing to Mr Gonzalez. Please post the address if you have
