Status of L2 and H1 Visa

Hi All ,

I am currently on L2 visa and am working in a company A. I have already applied for my H1 visa and I don't know if my application has been picked up or not in random lottery picking. During the next month I would have to go back to India for a personal reason.

What would be the effect of this on my VISA status. Would I have to get my stamping done again in India ? Will my L2 be valid (My husband would be in US and continuing with his current job) ?. Would there be any impact to my H1 application ?

Hi,

If you have valid L2 Visa, you can come back to US. Since you have applied for H1 visa in us, I believe you would have applied for Adjustment of status, which would be invalid, since you I-94 number will change. You need to go back to India for H1 stamping to start working on H1. There won't be any impact on H1 or L2 because of your travel.
