Status of H4 after I-485 approval

Hi,

I am on H1 right now and my spouse joined me on H4 last week. I did my 2nd FP yesterday and might be on final stages of I-485 approval.I am in process of getting my spouse name added to my Green Card Application.

What would happen if mine I-485 case is approved before my spouse name is addded to my application. After my approval I would no longer be on H1 and her H4 would also cancel. Would her stay be legal in US?

Can I file the application for spouse visa ( for Green Card Holders ) while she is staying with me in US.

Once you get approved, her H4 becomes invalid automatically. She need to go back to her country and then you can apply for follow-to-join for her. That takes months and there will be lots of uncertainity about waiting period.

As she is here already with H4, don't waste A SECOND of time. Apply for her 485 ASAP. Again, DO NOT waste time.
 
file her 485 ASAP , else she have to go back after your approval. once she's in 485 stage she can stay here under AOS.
