folks,
Any idea what if a H-4 holder will lose the H-4 status once he/she use the EAD card. I understand it is the case fro H-1 holder. But my attorney said for H-4 it is different, H-4 status is still valid even after you use EAD.
Thanks for any comments.

H4 is tied to validity of H1 if H1 is valid then H4 is also valid, no matter H4 holder is using EAD or not. I had the same situation at one time.

True. Spouse of a valid H-1 holder can get a
H-4 visa stamp even after he/she has used the ead card. (from personal experience)

Wife's status

Hi,

My wife is on F-1 visa presently. She will be graduating in May 2003. Her F-1 visa is valid until 2006.

I filed my I-140/I-485 concurrently and also applied for EAD's for both me and my wife three months back. Our EAD's haven't been approved by the INS yet.

1) Will my wife be out of status if she graduates in May 2003 and if for any reason my I-485 is not approved ?.

2) Is it better for my wife to apply for her EAD(what they call practical training in US schools) through school ?. Is it valid to have two EAD applications pending(for my wife) with the INS but with different INS service center's ?.

Thanks
