Status enquiry delays the processing?!!

Hi friends,

I was concerned about my I1-40 case and asked my paralegal to start "status enquiry" with VSC.

He replied, "The dates posted by the Service are approximate. The do not reflect true processing time and do not mean that cases received by that date have been approved.
We have seen approvals for cases filed in February 2003 and prior only. We have not seen any approvals after that date.
Again, processing time is approximately one year and you must allow the Service time to issue a decision.
At this time the only thing an inquiry would accomplish is further processing delays by removing the case from processing to issue a response. If you insist on delaying your case we will proceed with an inquiry. We suggest you wait patiently for a decision to be issued in the allotted timeframe."

Probably it is true that the posted processing dates don’t mean anything, but I am not convinced to believe that "status enquiry" would delay the process!! :confused:

What do you guys think about this?

Yes, my paralegal (FDBL) told me the same too. As they are such a big firm, I suppose they would know best.

That's BS for a number of reasons - individual paralegals (and sometimes even attorneys) often times do not know the process as well as some of the members of this forum (Hey, this process affects our lives, it means nothing to them).

A paralegal from FDBL recently told me that an inquiry would be initiated in my case - no mention of delayed processing.

I have seen nothing on these forums that can attest to the fact that an inquiry delays processing.
 
In my opinion, that is some stupid theory that your paralegal has come up with. I never heard of anything like that. If the published date is past 30 days of your RD, initiate an inquiry. Since it is I140, your employer or the lawyer should be willing to initiate the inquiry.

I agree with hakoonamatata... go for the status inquiry.. I did that and it triggered my I-140. Good luck...
 
Where can I find a written document from USCIS justify and explain about "status inquiry” and its procedure?

My employer obviously believe the statement from paralegal, so if I can find some documentation or link to backup my statement about the status enquiry, it would be great.

Any help?

It's on the page that lists processing dates for each service center.
