Please note my case deatils:
H1 Expired on September 01, 2004
GC labor applied on August 01, 2003
7th Year Extension filed on July 01, 2004
Received a RFE for the 7th Year Extension filed on July 01, 2004 asking for proof of GC filing.
Sent a document to USCIS obtained from Regional office (Only Employer could get that document, since PA does not send any notification that they have received the documents)
Received a DENIED notice stating that 7th Year Extension was filed before 365 days have elapsed on NOVEMBER 01, 2004.
My attorney would be filing an appeal.
I would appreciate if you could clarify the following:
1. What is my status currently?
2. If I am out of status, from what time would the clock starts, is it from the day i received denied notice (11/01/04) or H1b Expiry (09/01/04)?
