Status Change to H4 on Layoff

There are many discussions on h1 to h4 conversion after layoffs without any reples. Gurus please answer.

1. Should one attempt to try change of status after layoff or leave country?

2. If the application is denied, Is it possible to goto home country and successfully get a H4 visa?

3. How is the accumulated out of status time calculated? Does it include the time the application pends with INS?
