Currently I'm on OPT, which ends in June. I will be filing for H1-B visa in April/May. But as the new H1 quota will not begin before October, I have 3-4 months, during which I can't work.
Can I stay legally in the US during those 3-4 months?

I also have a PhD admit for Fall 2004. My F-1 visa is valid till 2006. I am thinking of leaving US after OPT end and then coming back on my PhD I-20.
Will there be any problem if I re-enter US on the PhD I-20 in Fall 2004, when my H1 application is filed and still under process?
