State of residency for new immigrants

Hello there, I am just planning my move to the US. What are the residency requirements for new immigrants in order for me to be considered an in-state resident for tuition and benefits purposes?

For US citizens and residents, generally they will have to live in that state for at least one year in order to qualify to be in-state resident.

I heard that for new immigrants to the US, the first state they choose to reside in, they would be considered a in-state resident immediately without having to meet the 1 year requirement. It kind of make sense because US citizens and residents should all have a "Home State", but for new immigrants who just arrived in the US and would not have a state where they can be consider resident.

Can someone confirm if this is true? or do new immigrants still have to meet the one year requirement in order to be considered a resident of that state?

That is something that would be decided by each college for their own admissions - but here is an example of a favorable exception being described...

"1. Students claiming to be immigrants must present proof of their status by providing the campus with a valid Permanent Resident Card. Once a student's immigrant status has been verified, the student may then establish New York State residency by meeting the domicile criteria. See Proof of Domicile (above)."

Based on this quote from the link, immigrants still have to meet the 12 month domicile criteria for this particular college I assume.

That is not how I took it. I think there is an exception for immigrants (at least at that college). However, as I mentioned - this is something that should be checked with the college you are interested in attending.
