State labor cleared,waiting on federal...

hi,

Quite complicated, but will appreciate any advice from any of you. Here it goes;

I am 20 and on H-4 right now,dependent to my dad(who is on H-1). We filed for GC in Oct-2001 ,and got our state level labor cleared in Feb 2003 (!!!!heights). THe problem now is that, I am turning 21 in few days and we still haven't got our federal cleared and it looks like I'll be kicked out of my any chances of having GC with my dad since i'll turn 21 and will no longer be considered a dependent. My dad's lawyer always kept us in dark and never told us about these situations or helped us in any way to find a way out. He said he talked to the senator,but of no help. I am worried at this point, as my fees will grow by 400% if i convert from H-4 to F-1.
BTW, employer's company is Atlanta based.

Was wondering if I could get any advices in this matter..or if anyone xperienced such a situation. It'll be too late for me to do anything now,but would want to hear what could have been done

Why don't you have a consultation with a famous attorney like Rajiv Khanna or Sheila Murthy or Shusterman? They are very knowledgeable and can help you.
 
Hi,

I think there's some act that protects against this (child status
protection act). Don't know who is eligible etc., but maybe
you can request DOL to expedite on this basis.

Better talk to to a a knowledgeable attorney!
 
Wow, I just read teh Child Protection ACT (CSPA), which perfectly suits my situation, if only my lawyer had talked to us about this.Well anyway, Thanks a ton guys. A ray of hope!
