EAD

Keep in mind that 'E' in EAD stands for 'Employment' not 'Entrepreneurship'.

So you wanna check with your attorney on the legality of EAD for entrepreneurship.

But......

You cann't work in anyway for that company.
You can open a company no mattter what visa you have, its same as owning stocks. But the key is you can not work for that company.
Its like you can not work for another company (same field or not) using your EAD, the company/business you are trying to foam is just another company.

u can ofcourse start ur own company on EAD and work for it as well, provided u are maintaining ur job with the sponsoring employer. EAD allows u to moonlight anyway u want - work part time elsewhere, start ur own business, whatever u want. The only caveat is u have to maintain ur sponsoring job (or a similar job with some other employer, if you want to use AC-21).
 
What if I start a company in my wife's name(who is the secondary applicatant..I'm the primary applicant) and I run the show? Is it possible? My wife has EAD too but happens to be working as a DBA. But if we start a small company(say a .com), my wife can start with no problem right?

Are u trying to find a way to get GC without depending on ur job or are u trying to find a way to work part-time elsewhere and earn some extra $$?

If u are trying to get GC out of this, the new co u form cannot be the basis for ur GC approval. U "have to be" employed at ur sponsoring job or a similar job at a company "not partially or in-whole owned by u or ur immediate family".

ofcourse, if u are just trying to find a way to make extra money in addition to ur salary (not to mention tax benefits of having a company), u or ur wife or both can form companies and work thru them as u wish.. it is really simple to form them and with LLC, it is simple to operate as well. but this work has to be in "addition" to you maintaining ur regular job.

The response I got from my lawyer many months back is that we can start a company but we need to keep the sponsoring employer for GC purpose.

Starting company on the women's name has tax privilages.

Before I ask you a question.
I am trying to find this to earn some extra $$ and not for GC, purpose. I am going to continue my current job.
But I have asked my lawyer once about working ANOTHER job on EAD, and he denied, saying you can not do that.

And from the forum which I mentioned in earlier post, (Starting and doing business in USA) I found that you can open a company but can not work for that company in any way.

So if you can please tell me where did you get this info from, like some website or lawyer.... share that info with us...

When you are on H1B you cant work for the company. But on EAD you can and get salary from the company. Its very important that you need to know the tax issues, the type of company etc... I started my own company. People like you should come forward and help the current economy to boost up.
 
I'm the primary applicant for my GC. My wife is working full time in EAD. Can my wife start a company(which I may be helping her more)? My wife was in H1B visa before getting the EAD.

Yes. See the discussion above. Although if u help her (that is to say if you earn money thru her company), u would have seized ur H1 status and moved to EAD status as well.
 
H1B and EAD

You can continue H1B with your sponsor and work for the new company on EAD. Remember that starting a company on your wife has advantages.
 
I talked to my lawyer again after reading all this post, and this time he told me that "you can own as well as work for the your new company" but as -ab said you lose your H-1b status and you work on EAD as oppose to 140seekerJune said in his/her last post.

And It seems 140seekerJune has gathered so much info since he is the one who started this thread. Anyway question for you.. have you find this info thru some lawyer or some web site other then -ab has posted above or .... and "What are all the benefits if I start a company under my wife?"

Because my lawyer specifically that if you want to work for another company you lose your h-1, but if your other company is ready to apply con-current h-1 then you can do that and you don't lose H-1 (may be too tough/or in lawyers benefit atleast)

opening a company

I happened to talk to my lawyer. You can open a company and work for it. The only thing is you need to maintain the job with your GC sponsoring employer. Another important thing is you cannot open an S corporation for which you will have to be a resident alien of U.S.A. You can either open a C corporation or LLC.

This is not a legal advice. You may consult an Attorney for proper advice.

I spoke to my lawyer when I got into this issue, but haven't got any info from any other site. I have EAD but the lawyer told me there is no need to change the status of H1B, so I did not inform my employer that I want to be on EAD. I am not sure whether I am making a mistake. I use EAD status for my company and H1 for the sposoring employer. I think if you leave your sponsoring employer to a different company, then you are forced to use only EAD.

Some states have rules that you need to be a US citizen. Some states dont. There are also provisions for non-residents to have companies in the US.

There are consessions for "women run business" and tax benefits though I am not sure about the technicalities. The local country should approve the application. The local county may be able to give info about the benefits. BTW, mine is not a "women run company".
