Hi,
My friend is expecting her Citizenship oath around June 13 in Santa Ana,California.
She will be applying for her husband's adjustment of status I-485(His petition for I-130 has already
been approved) on the same day that she takes the oath.

Can she file I-765 on the same day as my oath as well?

Her husband is currently on OPT and his OPT is ending on 31st July, 2005.
He is currently employed based on OPT.

Does he have legal authorization to work in the USA from the day of application of /the day the INS receives(receipt date on INS notice of Action) I-765?
Or he has to wait till he gets his work permit?

If he has to wait, what is the average time it can take for him to get his
work authorization.

Thanks,
kp

NO -- he has to wait till he gets the approved EAD card before he can work.
He CANNOT work on the basis of a pending 765 application.

EADs are taking about 60-70 days (approx) for processing.

If the EAD application is pending for more than 90 days, he can apply for an interim EAD (iEAD) at a local office - this is usually granted on the very same day.
