Start-up Employer qualify to file H1 petition?

My potential H-1B sponsor is a start-up tech company founded in 2006, currently employing two full-time US citizens and 3 contractors. Revenue for 2008 around half a million USD. Tax returns and payrolll taxes up-to-date.
My question is: does this employer qualify to file a H1-B petition for me?
