Start my own company and obtain L1

Hi there!

I am on H1-B visa, which will expire in July. My wife was a student on H-4. In order to continue her education she had to apply for a change of status (from H-4 to F-1). And in order for me to stay with her legally in the US I also had to apply for a change of status (from H1-B to F2).

Now, I would like to know if it is possible to start my own company and obtain L1 visa (change from F2 to L1). I am particular interested in starting up a company in Canada (because I am a Canadian Permanent Resident) but working in Minnesota, USA. (I spent over 10 years in Minnesota and I know the business environment better, and I don't want to move to Canada at this time.) If this is impossible I would be interested in starting up a company in Minnesota. As far as I know everyone can start a company (including foreigners) in the US. Obtaining L1 is a main issue though.

Person on H or F visa cannot start a company. You can start a company in Canada but need to have worked at least one year outside US before you can consider coming to US on L visa.

US scrutinizes company credentials prior to issuing L visa for small and new companies.
