Stamping for third year extension

I am not sure if this question could be clubbed with any existing question and hence I have created a separate thread. So here is my question:

After being on H1 for 2 yrs 3 months, I changed my job. The new company filed for my H1 and provided me I797. The expiry date as per new I797 is Jan 2011 since this company applied on the basis of 3 yrs employment starting from Jan 08.

However, as per my old I797 and I94, my H1 expiry date is Nov 2008. And this is also the time when my first 3 years on H1 expires.

I am planning a trip out of the country in Dec 08 and wondering if I need to go for stamping at the US consulate office in the country I am visiting (for 3 years extension). Please advice.

You can travel during December 2008 but you need a visa stamp at the US consulate for re-entry. Your current status was extended up to January 2011 and this will be the basis of the new visa stamping. By the way the old I-94 is invalid please use the new I-94 form attached with the I-797 approval notice during departing the US.
