stamp on I-94 less than H1 expiry date

I have a valid H1B until August 2005, went abroad, got H1-B visa stamped, came back to USA but at the port at entry, they stamped H1-B admitted only until December 28, 2003 coz my passport was expiring on that date.

Now, I got the renewed passport went to the local INS office and asked them to correct the date on the the I-94, they took the I-94 gave the reason that the I-94 has expired , told me to get to the lawyer who processed my H1-B and get the copy of the original I-94 and keep it with the passport.

Now, I am worried about two things:

My status, am I legal to work in USA till August 2005 - the date on which my H1-B expires or I can only work until Dec. 28th 2003 - the date that was there on the I-94 card.

My second question is what do I do to get the I-94 card

Thanks for the reply JoeF. Now I was also thinking of going to Mexico. Since I am located in Kansas, the best bet for me would be to go to Mexico thru El Paso. Now, I would appreciate if you let me know if I require a VISA to get into Mexico.

If, yes then do you know what it takes to get a mexican visa and how long it usually takes coz I think I have to cross the border before 28th Dec. 2003.


Also, I went to the lawyer and he told me that to be completely safe I will have to file an H1-B to extend to the original date which does not make sense to me. Does it make sense to you?
