if you still have no status you can't file for I-485. however, you can file for 245(i) only if you meet the requirements and pay a $1000 penalty fee for overstaying your I-94. but if you meet all the requirements and file for AOS with or without the 245(i) you can file for an EAD (I-765). with the EAD you can work; thus, a SSN will be available so you can drive only if you meet the 6pts for your state of course. good luck with everything, im on the same boat as you, im currently waiting for my visa number then file for AOS under the 245(i)

adjusting your status is known for taking a long time. it really depends on where you live. many people in TX can use the DORA program and recieve their GC in 90 days, others wait around a year. it all depends. hang in tight, if you are about to file for I-485 and it is pending you are considered legal since you can work, go to school, etc. best of luck.

oh, since you are an immediate relative of a USC i think it is excused for being out of status while waiting to get your GC. i know it is excused under those circumstances if you marry a USC but im not 100% sure about a child of a USC. i would def ask a immigration lawyer, post question around appropriate sections of this forum to find the right answer. best of luck with all of this.
