SSN for H4 with EAD card

Hi,

I am relatively new for these forums. Me(H1b) and my wife's (H4) EADs were approved on 9/16/04 and were mailed to us. Our H1/H4 is valid until 12/14/04.

Recently we have been to Secial Security office in New Brunswick, NJ to apply SSN for my wife. They checked her status in their system and said that immigration people did change her status yet from H4 to EAD. So being on h4, she cannot apply for SSN. They asked us to contact the USCIS and get changed status from H4.

My question here is, does anybody get changed his/her status automatically once EAD was issued?
In my case do I really contact USCIS to change status before I apply for SSN? To my knowledge status would be changed only when somebody starts working on SSN.

Secondly, can anybody please update our below GC Status in 2004 excel?

Concurrent filing RD 4/12/04
EB2
I-140 RD 4/12/04
I-485 RD 4/12/04
I-765 AP 9/16/04
I-131 RFE Rcvd by USICS, 10/14/04

For my wife, it was very smooth. We both have got EAD, but still I am working on H1-B and she is in H4. We just filled the SSN application and went to the SSA Office. What they asked really bout the Passport, any sort of photo ID (she has the STATE ID), EAD Card and the Application(SSN).

It just took 10 business days to get her SSN.

:D Gosh - something is wrong - you and your so many friends get RFEs! Wonder how many friends you have. UN - do me a favor - make a list of all the RFEs that you and your friends ever got - it will surely be comprehensive list.

Now if I will tell you that I suspect my wife's name check will be a problem, hope you will not tell me same about you or your family.

I know what UN is saying in his post. It makes sense, RE-read it.

"The only thing I have seen is a comment joyd made to laborapproved and I guess khallili in the unrelated forums. I never saw their post. Since laborapproved had sent me an e-mail I sent him one back and asked what he did that got joyd so p.o. All he told me was that "nothing. i just made a funny face...I have nothing against indians".

You have to be unbiased in thinking what other would feel about it. Think that an Indian did this mischief and was done with name of Jharkhandi in the post. What is expected out of Jharkhandi? I know people from other side too on this portal and have always had very good contact. Even without it I would have surely taken a stand against the post and made it clear what I think about it. Secondly I would have never talked about laborapproved.

O Yar!

Let's just all try to be friends and help each other out rather than bringing each other down. We all know about immigration, some know more and some less. The heart of the matter is we ALL want our green cards swiftly and move on with our lives. We should all stand united and keep a positive attitude while helping each other out. I think of this forum as a house we are living in while we wait for the "hara pata" to come. We are not going to be around this forum once we get our Green cards so lets just take it easy and be friends. :)

PS: FYI, I am from Lahore, Pakistan. What about you?

HELP!!! Jharkhandi

Hello,

Iam planning to get SSN for my wife, my 140 is approved and we got EAD's, right now iam working on H1 and my wife is on H4, if she applies for SSN, will it activates EAD and she looses her H4 status?

Please advise.

It will definitely not do so. Only working on the EAD activates it whereby she will lose her H4 status. Getting the SSN early on is a good idea.

There is no federal law administered by any federal agency which prohibits the hiring of a person based solely on the fact that the person does not have a Social Security Number (SSN). Similarly, there is no federal law which prohibits the making of a payment to a person based solely on the fact that the person does not have an SSN.

However, there are federal laws and regulations which require the reporting of a payee's TIN (Taxpayer Identification Number--SSN or ITIN) on federal information returns and payee statements such as forms W-2, 1099, 1042-S, etc. In addition, federal regulations require (with a few exceptions) that all tax treaty claims made on Forms 8233, W-8BEN, or W-9 be accompanied by the beneficial owner's TIN.

The IRS is quite aware of the Social Security Administration's new procedures effective since 09-30-2002 about not issuing an SSN to any alien for whom it cannot confirm his identity and immigration status from the USCIS (United States Citizenship and Immigration Services—formerly the INS). In addition, the IRS is quite aware of the delays in securing an SSN which these new procedures will cause many aliens. Furthermore, in the situation in which an alien is work-authorized under the immigration law and is eligible to request an SSN, but who is experiencing delays in securing an SSN caused by the SSA's new procedures, the IRS will not issue an ITIN (Individual Taxpayer Identification Number) to such an alien.

With respect to IRS penalties related to the payor's failure to furnish a payee TIN on an information return and on a payee statement, the fact that the payor does not have a payee TIN to report because the SSA is delaying an issuance of an SSN to a work-authorized alien solely because of its new procedures, will cause the IRS to be quite favorable toward considering this situation one in which "reasonable cause" exists for not asserting such penalties. The payor should keep documentation to show that his failure to supply a payee TIN is caused solely by the SSA's new procedures for issuing SSN's to aliens.

However, please remember the following two points:

A Form W-4 submitted to an employer which does not report the employee's SSN is an invalid form W-4, and the employer is required to withhold on the employee's wages at the rates corresponding to Single filing status, zero personal exemptions allowed. Withholding at these rates must continue until the employee submits a proper Form W-4 reporting his SSN.
Any withholding agent (with certain exceptions) who receives a Form 8233, W-8BEN, or W-9 without a payee TIN for the purpose of claiming a tax treaty benefit is not allowed to grant such tax treaty benefit until he receives a proper Form 8233, W-8BEN, or W-9 which does report the payee's TIN. However, a form 8233 or W-8BEN without a payee TIN is still valid for the purpose of declaring that the payee is a foreign person, subject to the withholding and reporting rules which apply to payments made to foreign persons.
The IRS cannot speak to the issue of potential penalties which could be imposed by other federal, state, or local agencies for the failure of an employer or payor to report a payee's TIN on any required documents, except to note that the filing of the immigration Form I-9 without an SSN does not constitute grounds, in and of itself, to reject the validity of the Form I-9. If an alien employee can prove his work-eligibility with documents listed on Form I-9 other than a U.S. social security card, then the alien's Form I-9, even though submitted without an SSN, is valid under the immigration law.

I was bit concerned about our status as i dont want to loose my H1/H4 by applying SSN for my wife.

Per yeppo it is safe to get SSN without affecting the Visa status.I will go ahead and apply SSN for my wife.
