Hi,

I got my H1B visa sometime back. I was on a H4 earlier. So, I went to the SSA office with my I-797 which had my I-94 and my passport. The accepted my application and told me I would hear back in 4 weeks. I got a letter a couple of days back saying I had to provide supporting documents, The letter read "H4 status has to also submit employment authorization I766 or 688B" But on the SSA website it clearly mentions that I only need my I-94 and Passport. I think they have me confused that I am still on H4 visa which is not true. My visa reads H4 because I will be able to get the H1B stamping only after October 1. What do I do next?

Okay, this is not the end of my worries. So, when I received the letter I quickly went back and checked my I-797, to my shock, the I-94 was missing, and Believe me after I went to the SSA office I had left everything untouched. I think the SSA personnel took my I-94 and did not return it back to me. I didnt notice at that time, but now its gone. I dont know what to do. What should I do? I am worried. I have to get my stamping in a few weeks/days and now I dont have my I-94. Please please advise.

I am really worried.

File USCIS form I-102 for replacement of I-94, fee is $320.00. Always make it a point to copy or scan any immigration related documents

So you mean to say that I wont get my I-94 back from the SSA office? They took..I know for sure....Now I havew to pay $320???
