My husband passed 3months ago and I have a USC 4yo daughter who lives
with me. My status was not changed until my husband passed (am already
overstaying). My question is, can I apply my daughter for a SS
survivor benefit, without risking myself being questioned about my immigration status during my interview in SS office? Please let me know what should I do. Thank you for your time. Jem

I am so sorry for your loss and know exactly how you feel as my husband passed on 13th May 2006 after a short illness

I am concerned that you say your status was not changed until after your husband died and then say you are overstaying

As my husband was the petitioner and my son the beneficiary, the cases died with my husband

I am really concerned about you and your case

If your case is still pending and husband died you may be in trouble. Was your husband a USC and did he die as a result of conflict?

If your husband is the biological father of your daughter and you have her BC (birth certificate) that shows he is the father, that is the first step.

Next is to determine if the father's Social Security account is insured for survivor benefits.

If he has worked a minimum of 10 years making at least $3,600.00 per year he is what is called "fully insured"

If not then the only other possibility is to be "currently insured". Which means you take the quarter (three month period, ie.. Jan-Mar, or Apr-Jun, or Jul-Sep, or Oct-Dec) in which the father passed away in, and count backwards 13 quarters(3 years 3 months). Now within this 3 year 3 month stretch, he must have made 6 "quarter credits".

It takes approximately $900.00 of gross wages to make 1 quarter-credit or "QC". You can earn a total of 4 QC's in one year.

If you think he might be insured, cal SSA to schedule an appointment to file a survivors claim at 1-800-772-1213 7am to 7pm in any time zone.

As far as your Immigration status, SSA doesn't ask for yours as the person who is applying on behalf of your daughter, but they will need you to show valid id, ie..Mex passport, B1/B2 visa, matricular id card, ca id, or dirver lic.
