Spreading out severence package over longer period, any use?

Guys,

I got laid off and got a 60 day notice period
(full salary). Is the benefit of spreading this
period out over say 90 days (at 66% salary) to delay
the attorney sending in a Withdrawl of AOS?

Will 3 month unpaid leave a choice?

I was told that by CA law, you could have 3 months unpaid leave for your private reason each year. Maybe you could find out from your HR about the rule for unpaid leave. 3 month for 2001, maybe you could get 3 mons for 2002 as well. Do you think 6 months is enough for you? By the way, why will your attroney withdral your AOS? Kind of strange. I was told that by AC21 rule, after 180 days pending on INS, your company couldn\'t withdrawl your AOS. Good Lucky!

Right, I confirmed that they will not withdraw the petition,
only tell the INS that they no longer represent me.

Usually attroney will inform INS when end of the employment relationship. Per your posted before, you will have another 2 monthes employment relationship with your company. After that, if you will be in vacation or leave, you still have employment relationship with your company. I guess you will be fine until you are out of the employee list. You might discuss with HR. Please consult a good immigration attroney before you make your decision.
 
retain the same attorney as your representative

after the termination, pay the attorney by yourself and retain them as your legal representative until your case goes through. so, the attorney will not inform the INS that they no longer represent you.
 
Problem is that the same attorney won\'t represent me.

Another one within the same firm will (this is due to
conflict of interests requirements).

So they will still send in the I824 notice saying that
there is a change of representative.
