Spouses in US - V visa - H. R. 3701

hey guys with the spouses in the US or outside of US, did anybody figure out the way for her/his spouse to stay in the US/or to bring her to the US? Once we get our approval, our spouse can apply for visa number, and it might take 6 years to get it. My wife is here with me on F-1. Now, she would have to maintain legal status all these years 6 years x $$.$$$$.$$/per year for her school, it might kill me in the end. I've been looking for alternative way, but no luck. Here are some questions to disscuss:
  • Once we have a child, can she change her status based on the child that is few months old?
  • Is it better to wait 4 years (instead of 6) untill I become US citizens? In any case, she has to mainain legal residence. Only in this case is 4 years + few months until I get my GC approval instead of 6 if you Petition for your relative. Maybe apply for her visa number first, and then wait until I get my citizenship and then try to change her status. If in the mean while they change the law or the backlog, better for us.
  • What about V visa? They say that if you applied for immigrant number 3 years ago, your spouse can get V visa to join you in the US (or stay in the US) and wait for her/his number. They just introduced new bil H.R. 3701 to strike these 3 years to 6 months. This could be a nice option if this bill ever passes.

Any other legal way??? Maybe we already talked about this, but maybe somebody figured out a loophole in the law. Opinions?

There is a new bill to be considered by congress but it seems that they wont look at it before the end of this congressional session. this topic produced almost 1400 posts in another forum at this web site. Check it out http://boards.immigrationportal.com/showthread.php?s=&threadid=109096
 
yep, it looks like it is HR 3701. Now I have some reading to do. I can't believe how many post in that forum :) we can just hope that this will pass. however, in the worst case scenario, any other way? what is the current wait on I-130 for LPR?
 
wait, where did I get the info that I-130 takes 6 years?? :confused: :confused: :confused: I had to read it somewhere, but it looks like it is invalid info. I've been checking processing dates, but never pay attention to I-130 applications (because I still didn't file it :))

6 years !!!
That soldifies my point about Bush. if he really has "compassionate conservatism," he would care more about those who have immigrated legally and played according to the rules. Rather, he is trying to court the hispanic vote by legalizing those who do not have legal residency in the USA

I recalled this number from a previous post by Gilbert. He is the expert and we miss him :(
 
what can we do man, don't ask me how much I have spent for my wife school. If I'm one day late, they call and treaten me that they would send her back home. It really sucks to fight with these guys. And add immigration to that ... it is not an easy life as some people would say. this is not a complaint, but a reality. I wanted to marry my wife and nobody else and I would do it again. But I will not be separated from her ever again, what ever it takes. If I have to spend next 6 years in agony, I will do so and nobody will tell me that I should have married american citizen. I will not trade my happiness for any money in this world or for anybody. Reality sucks, but we have to fight it. In the end it will be worth it. It is true that america excepted us, but it is not the best immigration system in the world. In Canda, we would have a citizenship by now and even a US GC. 3 years to citizenship, and then you can legally work here. Anyway, we all know that political system sucks and that this is not true democracy, but so what. There are only few countries in the world that have true democracy, and they have their own problems. So, just be patient and let's try to find those loopholes.

I appreciate your struggle with this issue but i will never have to deal with this since i am married to an American woman. I never used my marriage to get my green card and i met my wife long after i applied for asylum.
