I have an interesting problem.
I am scheduled for a citizenship interview in September. My spouse is here in the US with me on a visitor's visa. Her visa expires in August. We will apply for an extension of her visa. If that is successful, I will file for her GC as soon as I take my oath.
However, if her visa extension is denied, I'm stuck as she'll have to go back to her home country and it'll take a long time for me to apply for her GC thru that country's embassy.
Question 1) Can she over stay on her visa if I know that I'll be applying for her GC in a month or 2 after her visa expires?
Question 2) I would like her to travel outside of the US with me soon. If I apply for PR after her visa expires, can she travel on the I-131? Or do I have to wait for her GC to physically arrive?
Question 3) How long after I file the I-485 does the physical GC arrive? I live in Chicago.
