I have Green card and my wife is waiting for approval.
We are travelling to india on this friday. While coming back at port of entry, will they give I-94? and validity how long?
is it until the advance payrole expires? Please reply me. I would like to know before I leave.

thanks in advance

I don't think you will get I-94 any more.

But your wife need to fill in I-94 form and stamp will show as "paroled until ..AP expiration date".

Thanks for the reply.

when leaving the conuntry, What do I need to show for my wife's stay here.
Ap or 485 Receipt? If they ask, What is my wife's status?

As I have green card, she will no longer be on H4 I think.

Thanks

Gcard600,

While leaving you will be only dealing with airlines, not with USCIS immigration officers. So all they need is AP document. It's your responsiblity to handover all I-94s of your wife at airline counter. That is it.. you all set to go..

Your wife will be on AOS not on H4 .. as she filed I-485. If H4 visa is not expired and not using EAD, then she can use H4 visa also. If you give more details, somebody can answer.

H4 visa is dependent on spouse H1 visa. Once spouse has green card then H1 visa is invalid so H4 visa is invalid. EAD and AP is the way to go.

wrong information. If somebody entered on H4 and applied AOS then that person is still on H4[assuming he/she never used EAD].

Actually it was the right information. If the primary applicant's GC is approved then his H1 becomes invalid. Automatically the dependent H4 gets invalid
