Spouse Travel .. Question?

I have GC in hand. But wife's case is not approved still pending. I am planning to goto india in Feb. She has Advance parole and EAD.

Now what is her status, H4 or AOS pending.? what docs she should carry for port of entry?

Please advise me.

I am in the exact same situation. My GC approved, spouse's not. We have travel plans in April/May.
Now, to answer your question...your spouse is on AOS pending. H4 is invalid now since your GC has been approved. She shud carry her AP, I485 notices, passport.
 
If Approved

I am in the same situation ... what happens if her case is approved when u are in India .. Will AP be cancelled? or ahe can come back without problem??

She shud be ok if she has a valid AP. Following is from Murthy's today...

Chat User : Hello, Ms. Murthy. My wife has to go to India on advance parole. If her I-485 gets approved while she is gone, will she have trouble coming back into the U.S.?

Attorney Murthy : She should not have a problem in being paroled back into the U.S. even if her I-485 has been approved while she is abroad. There are some USCIS liaison meeting notes on this specific issue where the USCIS states that a person is allowed to be paroled back in and then, after reentering, the person goes to the local USCIS district office to get the PP stamped with the I-551 stamp as temporary evidence of lawful permanent resident status.
 
Travel on AP with current status as AOS pending

I have a similar situation as pv1976 and gcard600, were in husband's GC is approved and spouse's 485 is pending.

Spouse does have a H4 stamp on the passport with expiry only in 2006 but I believe that H4 stamp is now invalid just because the husband has already received the GC and is not on H1 anymore.

Question is if spouse has to travel to India via Frankfurt using AP, is a germany airport transit visa required for ongoing and return trip ?
