Spouse out of status H1 to H4.

I am on H1 since Oct 1998. My H1 expires in Oct 2004. Recently got my LC [NYNJ applied Apr2001] approved. Here is my concern:

My husband entered on H4 and converted to H1. But has rarely got projects and is out of status.

Now I would like to convert him to H4 so as not to hurt my I140/I485 concurrent. What steps should I take?

Will I face problems because of his status [or the lack of it]? What can I do to rectify the situation however late.

Hello,

write ur husband's details. How long has he been out of status? if it is more than 6 months then it is big trouble. Ur huband will need latest paystubs to convert H-1 to H-4.

As fas as I-485 concern, If u have applied ur labour before April 30, 2001, u my take advantage for 245i for ur husbnd.

talk to ur lawyer as soon as possible about ur husband's out of status.
